Workplace Investigations

California’s Fair Employment and Housing Act (FEHA) makes it an unlawful employment practice for employers to fail to take all reasonable steps necessary to prevent harassment or discrimination.  Employers therefore have a legal duty to promptly conduct an impartial, thorough investigation once it learns of employee complaints of harassment or discrimination.  The most significant measure an employer can take in response to a complaint is to launch an investigation to determine whether the complaint is justified and whether corrective action is necessary.
